Agreement	EbonyOnline TERMS & CONDITIONS For the purpose of the terms & conditions: The “Company” means Ebonyonline.net The “Client” means the user or person who subscribes or uses the service. The “User” means the clients who uses the service or registers to attend These terms and conditions apply to all dealings between The Company and the Client to the exclusion of any other terms and conditions whether they appear on the stationery or correspondence of the Client or elsewhere, unless otherwise agreed in writing by The Company Privacy Policy When you supply any personal information to The Company it will only be used within the guidelines stated below and will never be provided to anyone outside these terms without first obtaining your consent, unless we are obliged by law to disclose it. We will hold your personal information on our system for as long as the client uses the service you have requested, and remove it in the event that the purpose has been met or until further instruction from you. We will ensure that all personal information supplied is held securely, in accordance with the Data Protection Act 1998. Intellectual Property You acknowledge that all copyright, trade marks and other intellectual property rights in and relating to The Company are owned by The Company Material may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal non-commercial home use. All other use requires the prior written permission of the user or should be in accordance with the Copyright, Designs and Patents Act 1998. Prices & Payment All prices are quoted inclusive of Value Added Tax. Once membership has been paid in full no refund or exchange can be offered. Upon expiry membership is automatically renewed. If you do not wish to renew your membership you must notify The Company at least one month prior to the renewal date. Tickets are non-refundable and cannot be exchanged. Apart from where a fixed price has been agreed and specified as such in writing, all prices quoted by the The Company can be amended upon notice to the Client in the event of errors or omissions in any Quotation or where an increase is caused by a change in circumstances beyond the reasonable control of the The Company including increases in prices imposed upon the The Company by its suppliers in connection with an Event. If The Company in its absolute discretion, and in writing waives the conditions relating to the payment of deposits at prescribed dates prior to the Event such waiver shall not prejudice the rights of the Company to recover from the Client the amount which would otherwise have been payable under these terms and conditions in the event of a cancellation or amendment of a booking. The Company reserves the right to withhold documentation (including without limitation event tickets where applicable) for the Event unless payment has been received in full. Force Majeure The Company shall bear no liability for loss damage delay or failure of performance however arising caused in circumstances outside of its control (and in these circumstances the Company may suspend or cancel the whole or any part of the Event). The Company will endeavour to notify the Client as quickly as reasonably possible if a Force Majeure event occurs. Loss & Damage Any loss or damage to equipment or property will be the responsibility of the Client and all replacement and repair costs will be charged in full. The Company does not accept any responsibility for the loss or damage of personal property belonging to Clients or their guests. Liability The maintenance of the equipment used to access the service is the responsibility of the Client and the Company bears no responsibility for equipment breaking down while using this service. The Company relies totally on its suppliers for correct information and whilst all details are given in good faith, The Company cannot accept responsibility for any inaccuracies Use of this site constitutes your acceptance of these terms and conditions, which take effect immediately on your first use of the site. The Company reserves the right to change these terms and conditions at any time by posting changes online. If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
